In 2025, North Dakota joined a growing number of states enacting laws that require websites hosting pornographic content to implement age verification measures. Signed by Governor Kelly Armstrong, Senate Bill 2380 and House Bill 1561 mandate that sites containing a "substantial portion" of sexual material harmful to minors must verify users’ ages using reasonable methods such as digitized IDs or government-issued identification.
The legislation’s scope is broad, covering explicit depictions of sexual acts, simulated or animated content, and even images of female nipples, pubic hair, and genitals. It also targets material lacking serious literary, artistic, political, or scientific value, judged by contemporary community standards to appeal to prurient interests.
While intended to protect minors, critics argue these laws infringe on First Amendment rights. Legal experts highlight that states do not have unchecked power to restrict access to ideas, and similar laws in states like California, Utah, and Texas have faced or are facing court challenges. The Texas law, akin to North Dakota’s, is currently under Supreme Court review.
Privacy concerns also loom large. Although North Dakota requires deletion of age verification data, history shows companies often retain such data longer than allowed, and verification services remain vulnerable to hacking. Moreover, age verification is frequently ineffective at truly blocking underage access.
Beyond pornography, age verification laws have expanded to other sectors like skincare products, dating apps, and diet pills, raising alarms about widespread erosion of privacy, security, and free expression online, as noted by the Electronic Frontier Foundation.
