Character AI and Google argued that their chatbot service is similar to expressive mediums like video games or social networks, which enjoy broad First Amendment protections. However, Judge Anne Conway expressed skepticism, stating she was "not prepared to hold that Character AI’s output is speech," emphasizing that the chatbot’s responses are generated dynamically based on user inputs rather than authored content.
