Epic Games has escalated its ongoing legal battle with Apple by filing a new court motion demanding that Apple be required to accept any compliant version of Fortnite onto the U.S. App Store storefront. This move follows a significant ruling by Judge Yvonne Gonzalez Rogers, who found Apple in "willful violation" of an injunction related to anti-competitive pricing practices, potentially paving the way for Fortnite's return to the platform.

Epic's legal challenge centers on Apple's App Store policies, particularly the commissions Apple charges for in-app purchases, which Epic argues are anti-competitive. The recent court ruling was seen as a major victory for Epic and other developers, as it opened the door for alternative payment options within apps, challenging Apple's strict control over its ecosystem.

Despite the ruling, Apple has announced it will appeal the decision. Meanwhile, Fortnite remains blocked on the U.S. App Store. Epic also revealed that Fortnite is currently unavailable on the Epic Games Store in Europe, which they attribute to Apple's actions. Apple, however, disputes this claim, stating that it requested Epic to resubmit the app update excluding the U.S. storefront to avoid impacting Fortnite's availability in other regions.

Apple's attorney Mark A. Perry communicated to Epic's legal team that Apple will not take action on Fortnite's app submission until the Ninth Circuit rules on their request for a partial stay of the injunction. Epic argues this delay effectively punishes them for challenging Apple's practices and denies them the benefits of the pro-competitive rules established by the court.
